If you believe content on DeepPlane.com infringes your copyright, send a written notice to the email above containing the elements required by 17 U.S.C. § 512(c)(3), detailed in the next section.
What a valid DMCA notice must include
Per 17 U.S.C. § 512(c)(3), a DMCA takedown notice must contain ALL of the following:
- A physical or electronic signature of the copyright owner (or authorized agent).
- Identification of the copyrighted work claimed to be infringed (e.g., title, URL of the original).
- Identification of the infringing material on DeepPlane.com with enough specificity to locate it (full URL to the surgeon profile page, before/after image, or specific content block).
- The complainant's contact information (full legal name, mailing address, telephone, email).
- A statement of good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notice is accurate and that the complainant is authorized to act on behalf of the copyright owner.
Missing any element means the notice is not legally valid and we cannot act on it. We will respond with a request for the missing fields rather than rejecting silently.
What happens after submission
- Auto-acknowledgment within 24 hours. You receive an automated reply confirming receipt and assigning your notice a tracking ID.
- Quarantine within 72 hours. If the notice is facially valid, the specific content (image, profile field, gallery entry) is hidden from public view pending review.
- Counter-notice opportunity. If the subject of the takedown is a claimed surgeon with a verified DeepPlane account, we forward your notice to them and give them 14 days to file a counter-notice per § 512(g).
- Resolution within 30 days. Outcomes: permanent removal, content restoration after counter-notice, or escalation to legal review. All actions are logged in our public removal log (anonymized).
Counter-notification
If your content was removed and you believe the removal was in error, you may submit a counter-notice to the same email. Per § 512(g)(3), a counter-notice must include your identification, signature, a sworn statement of good-faith belief that removal was a mistake, and consent to jurisdiction in the federal court for your district.
Repeat infringers
In accordance with § 512(i)(1)(A), DeepPlane.com maintains a policy of terminating access for users (including claimed surgeon accounts) who are determined to be repeat infringers under appropriate circumstances.
Misrepresentation
Under § 512(f), any person who knowingly materially misrepresents that material is infringing — or that material was removed by mistake — is liable for damages including costs and attorney's fees incurred by the alleged infringer, any copyright owner or licensee, and the service provider.
